What Is a fresh claim?

If you have already been through the asylum process and your appeals have been dismissed, you are legally considered “appeal-exhausted.” However, under UK law (specifically Paragraph 353 of the Immigration Rules), you have the right to submit new information to the Home Office. This process is officially known as making a further submission.

If the Home Office reviews your new information and decides it is significantly different from what you previously submitted, and that it has a realistic prospect of success before a judge, they will officially accept it as a fresh claim.
