What Is a fresh claim?
If you have already been through the asylum process and your appeals have been dismissed, you are legally considered “appeal-exhausted.” However, under UK law (specifically Paragraph 353 of the Immigration Rules), you have the right to submit new information to the Home Office. This process is officially known as making a further submission.
If the Home Office reviews your new information and decides it is significantly different from what you previously submitted, and that it has a realistic prospect of success before a judge, they will officially accept it as a fresh claim. This reopens your case and gives you a brand-new opportunity to be granted refugee status.
The two pillars of a successful fresh claim
The Home Office will not accept a fresh claim if you simply repeat what you said in your past interviews. To succeed, your further submission must be built on one or both of the following elements:
1. A significant change of circumstances
The world changes, and your personal life changes too. A change of circumstances can make it unsafe for you to return home now, even if the court decided it was safe in the past. Examples include:
- Changes in your home country: A new war breaks out, a political coup takes place, or a regime like the Houthis or Al-Shabaab gains control of your hometown, putting you at direct risk.
- Changes in your personal life: While living in the UK, you may have converted to a new religion, become politically active against your home government, or come to fully understand and express your LGBTQI+ identity.
Step 2. Crucial new evidence
A fresh claim can be built on new evidence that directly corrects the past mistakes or gaps in your initial application. This includes:
- Documents you could not get before: An original arrest warrant, court judgment, or newspaper article from back home that has finally reached you.
- Expert legal reports: A professional country expert report or an independent medical/psychological assessment that explicitly proves you suffered trauma, explaining why you struggled to tell your story consistently during your initial interviews.
Getting back on track after losing support and facing the street
When your appeals are exhausted, the Home Office will take steps to cut off your financial card and ask you to leave your asylum accommodation. Finding yourself sleeping on the street or relying on temporary shelter is incredibly difficult, but we can help you get back on track:
- Section 4 support: If you are destitute and can show that you are taking all reasonable steps to prepare to leave the UK, or that you have a temporary medical reason preventing travel, or—crucially—that you are actively preparing a fresh claim with a solicitor, you can apply for Section 4 support.
